Possiable Knee Surgery Malpractice

I'm a 29 year old female with a 3 year old daughter.  I had Arthoscopic knee surgery in aug. 03. I was put into physical therapy late, knee froze in a bent position.  Got pregnant with daughter, doctors office said they wouldn't treat me till after she was born. Ask for a new brace during that time...they said no and "It;s not our fault you got pregnant" It's now 08 and I have trouble on a daily basis.  I have knock knees and believe when the surgery was performed he corrected one of my knees with out knowing what he was doing.  No I have one sueto normal knee and one knocked knee.  No one seems to want to help me...any advice?

I don't know in what jurisdiction(State) you are but I am sure that whatever the merits of a malpractice claim you might have, the Statute of Limitations ran out long ago. I am not certain however but you would need a 5 year Statute in your case and that is even running out right now. The case and surgery is too old as a practical matter to reconstruct what happened and prove the surgery was done below the standard of care. There is certainly no legal recourse for you but there is almost always something medically that can be done. In worst case scenario, you could always have a total knee replacement although you are young for that of course. Good luck.
