Bankruptcy Law - Changing a chapter 13 to a chapter 7 HELP PLEASE!!!?

Postby edmondo93 » Sat Nov 19, 2011 12:52 am

This is a hypothetical question, but I know someone here will probably know the solution.

Hypo:

I am going to file for chapter 13 bankruptcy (which i do) then within 48 hours of the filing I dismiss the bankruptcy.

My question is, how much time (if any) would I have to wait in order to file a chapter 7 bankruptcy after I do this?

If you could site the federal statute(s) you used to find this that would help. I have been reading the federal code for a while and I can't figure this out!! Thanks ahead of time!

Why would anyone "hypothetically" want to do this? What are you "hypothetically" attempting to accomplish?

Bad plan. Get an attorney. Nearly all consumer bankruptcy attorneys offer free consultations. Take advantage of this to meet with one and get advice based on all of the details of your particular situation. You can find a referral at NACBA.org (National Association of Consumer Bankruptcy Attorneys).

This is when you defer to your bankruptcy attorney.
