CA DMV traffic school eligibility problem (DMV system error?)?

I recently got a Red Light Camera ticket in Hayward, CA for a rolling right hand turn and received a notice that I was not eligible for traffic school. I have no other citations in the last 18 months and have not attended traffic school but I was involved in a small fender bender accident about 9 months ago in the same county (Alameda). When I asked a court clerk about why I was not eligible for traffic school, I was told that it was because the DMV has a record that I was involved in an accident within the last 18 months. I went to a traffic court arraignment to request the court's permission to attend traffic school but was told that the DMV system shows that I am not eligible so even if the court granted me permission to attend traffic school, the DMV will not accept my traffic school completion form and the 1 point will show on my driving record and my insurance company will also be notified.

I was informed by the traffic commissioner that only the DMV can grant me permission to attend traffic school. Is this something that can be corrected by visiting the DMV? Any advice will be greatly appreciated.

As always the answer is no unless you ask. They have rules set in place, the question remains can you get them to bend those rules. 1 point is not going to make a difference at all unless it is the one point that sends you over the limit.

The courts and the DMV are two different levels of government. The DMV is NOT required to honor any "traffic School" arrangements ordered by the court. If the DMV says you aren't eligible, you won't be able to attend. Don't feel too bad. If you had a California CDL you would be completely prohibited from attending Traffic School.
