Traffic ticket error by cop?

Postby karlitis » Thu Jun 07, 2012 2:01 am

I was pulled over and given a ticket for using a wireless communication device under the age of 18. However, the officer put in the information wrong so that the offence was having more than one other person in the car that's not a family member. Which charge should I be prepared to fight in court?

I would stick with the extra person myself. It sounds a lot less serious than texting and driving, but maybe you should call up the ticket office and act like you can't find the ticket and for them to tell you what the ticket was for.

Another option would be to find out which one is worse according to thier laws and go with the other one.

I would go to court and point out the error that the officer made. Tell him that you didn't know what charge you should prepare to defend because of the officer's mistake.

The judge has the authority to dismiss the ticket or to allow the officer to amend the ticket. Usually he will dismiss.

Be sure to go to court. A mistake on a ticket does not make it invalid. You have to go to court and have the judge dismiss it. If you don't go to court, the judge will issue a failure to appear warrant for your arrest.

I wish you well.
