Error on speeding ticket?

Postby teyo » Fri Mar 30, 2012 5:36 am

My date to appear at court is coming soon for a speeding ticket, and while reviewing my materials and preparing for the court date the other day I noticed there was a big error (and a smaller one) on the ticket. I want to know what your opinion is on it. First error: There is no offense actually selected on the ticket. The officer filled in the numbers in the space for a speeding ticket but the box was left unchecked and therefore there is no offense actually listed in it. Second error: This is a minor one but I figured I would include it anyway as I've read about people saying that the date was far off on their ticket and had their case dismissed. The date /should/ read 2/3/12, however the way he wrote it it instead reads 2/3/17. I would like to know your take on these mistakes and your opinion on whether or not I should present these to the judge during my hearing. Thank you!

You should. Bring all sort of evidence or things with you associated with court. It could all help in the long run.

If you live in south carolina its not gonna make any difference. The judge will not dismiss any of it.

Error on speeding ticket?

The ticket will simply be amended, neither error is very big. If he had written 2/17/12 instead that would be a big error. Since we are no where near 2017 it won't amount to anything. Not writing the offense isn't going to get the ticket dismissed either.

The numbers ARE the offense. The check box is NOT grounds to dismiss anything.
The date is NOT wrong, just illegible. LOOK at a 2 and a 7.
If you WASTE the judge's time with either of these arguments, you TRASH any chance of leniency.
