Can a 19 years old girl from Sweden get jailed for chatting with a 17 years old boy from CA?

Postby tanishia » Mon May 28, 2012 3:42 am

I’m a 17 years old boy from CA, met a 19 years old Swedish girl online a couple of weeks ago. I’ve never had this much fun in my life, like the past weeks I’ve been talking with her.
We have exchanged pictures too (we were both fully dressed, there wasn't anything explicit about them).
In the past few days, I’ve been trying to tunnel our talk into a tiny bit erotic direction, which she didn’t seem to mind.
Just now she told me that she found out that chatting about sexual stuff with a minor is illegal in California, and I could get her “jailed” if we went any farther than this. She doesn't know if she should be concerned about this.

I looked after it, and found these laws:
http://law.onecle.com/california/penal/288.2.html
http://www.leginfo.ca.gov/cgi-bin/displaycode?section=pen&group=00001-01000&file=313-313.5

Well here are the questions:
-Can she violate Californian law by doing actions that are completely legal where she lives (the age of consent is 15 in Sweden), with an underage boy from here?
-If she can, is pure text-based communication enough for that? No pictures or video at all.
-Her primary concern is that if she ever enters the USA in the future, she might get arrested and face jail time. Is this correct?
-Sweden also has extradition treaty with the United States, but we both very much doubt she could be extradited for this. If anyone knows otherwise please tell.

If she actually can get into trouble for this, nothing can happen if I just move over to Nevada for the duration of our talks, right? What if I just tell her at the beginning of all our conversations that I’m in Nevada now (while I don’t really move there)? Would any of us be committing a crime?

Bonus question: Just looking at the law, it looks like it applies to minors too. If two 17 years old engage in a sexual conversation on the internet, both of them might face jail? I know having sex is “illegal” for 2 minors on paper, but nothing ever happens about that. Is this law actually taken seriously?

Thanks.

17 is hardly considered underage.
