I was driving at least 6-8 cars behind a cop and he slowed down and pull to the side until i passed him then he pulled me over. when i was passed him i was not speeding but yet he claims that i was speeding and gave me a ticket. (Note: this was 3 a.m. when there wasn't many cars and the end of the month) Can i fight this ticket in court? What is the likely hood of winning?
Yes he can and you will likely lose in court.
If he was driving the speed limit and you rapidly approached from behind and passed him, Obviously you were speeding.
He does not need to know the exact speed. Most jurisdictions have a statute for Unlawful speed, Does not need to specify how much or how fast.
