I want sue my ex landlord in small claims for the return of my security deposit she verbally promised to me and then 4 days later sent an email saying wasnt getting it because I didn't give sufficient notice that I was moving, which is false. I have a recorded conversation she had with me during the final walk through before I left for good, saying that she would have it in a weeks time and its been 1 month now. Is that recording valid to use in small claims court in New York?
I would guess so. I watch judge judy and judge mathis and so on, people use recordings alllll the time, It's a verbal agreement and you happen to have record of it, which is better then most people have when they have a verbal agreement!
Check NY state statutes and find out when a recording can be legally made of a conversation. I am a citizen of Minnesota and here, as long as one of the people being recorded is aware of the recording, it is legal.
Yes, if it's recorded, it is a valid evidence... The quality of the recording may be a factor, but most judges will be sympathetic to you if you play it....
