Can a tenant legailly have security camera running inside his apartment?

Postby barend31 » Wed Apr 11, 2012 11:17 am

I have a security camera looking out my window at my truck from the inside of my apartment, and was told by management i have to take it out of my window! Do they have any right by law to make me take it down?

Yes they do since you are recording activity on THEIR property. When you do not own property of your own, you don't exactly get to make the rules as to what you can do on someone else's property. If you want to install a camera...buy your own place.

If it is visible from the outside, then yes they can require this. If you can move it back enough that is is not visible to the public then you should be okay, but since they know it is there now they will be looking for it.

Yes, it is legal.

They own the property you are surveilling so yes, they can make you take it down.

Since the camera also videotapes anyone outside in a common area, yes they can request that you remove it. Why not just get a car alarm?

You need to write the owner a letter requesting a letter of explanation from the owner as to specifically why the camera can't be there. The owner can't act as a totalitarian simply because it's his property. You are engaging in an activity that is inside your rented space. Nothing in your lease agreement states you can't use a security camera for the safety of your property. In the letter to the property owner you need to state specifically what you are using the camera for. Tell him in the event of dispute you are willing to negotiate, but let him know that he does not have authority to tell you that it is "illegal" for you to point a webcam outside your window.

No. You are renting the inside space in the apartment. If your lease does not specifically say "tenant will not set up security camera" then just ignore them. Let them take you to court over it...judge will laugh at them!

why not? tenants also have the right to protect their own safety, no matter for personal safety or for property, security cameras can be legal things to use in the apartment.

I dont know but I dont think so because the camera is taping common areas outside that are shared by all tenants and you dont have permission to video tape people on the premises. Even if the camera is fixed on your car, it still could film other people so it is an invasion of their privacy.

(i think)
