Can an Employer fire you while you are still on Workers Compensation in the state of WV?

I substained a work related injury and was on workers compensation for awhile. I recently got released to go back to work when going to my place of employment they told me they didnt have any work for me and let me go. The next day I look in the local paper and there is an ad for positions available is this legal in the state of WV?

If there are no other important circumstances, you may win a wrongful termination suit, if they fired you because you took workers compensation.

Best to see an employment lawyer.

They need a legit reason to fire you, they cannot fire you because you got hurt while you were working for them, take them to court for lost wages or whatever you can.

you do not state wherther or not these positions were positions for which you were qualified, or the nature of your work related injury.
