Can another lawyer be trusted?

Postby arber47 » Sat Apr 02, 2011 7:30 am

I've heard about how lawyers (and judges and the bar) stick together. I have an issue with my lawyer. I don't want to sue him, but he lied to me about major aspects of my case (which I can prove through his written emails) which ended up costing me a bigger settlement that makes a significant difference. I don't know what to do about it exactly. I called the bar and they referred me to a legal malpractice attorney whose secretary has left me a message to call back to provide more details, but I don't know if "telling" on my lawyer to another lawyer is going to help resolve things. Can I even trust another lawyer will not call up mine and tell him his client is out to get him? Any thoughts on this?

A legal malpractice lawyer isn't going to have much of a career if he isn't willing go after other lawyers. You did the right thing by contacting the Bar Association. Now contact the lawyer they suggested.

Yes. You can trust a legal malpractice attorney not to call your former attorney and report confidential attorney-client communications. If he/she did that, it would be grounds for disbarment.

If the new attorney is representing you to take action against the former attorney, then, of course, there will need to be contact with the old attorney.

It's true that Lawyers are often reluctant to sue other lawyers, but that's not always the case. Sometimes they deserve it. In any event, whatever you tell your new lawyer will be privileged and he or she could be disbarred if they revealed it to your original attorney. Lawyers take attorney/client privilege very seriously, as do the Courts and State Attorney Disciplinary Councils. You'll be safe in discussing this matter.

Yes, you are doing exactly the right thing. Nobody wants to protect incompetent people in their field because it makes everybody look bad. As long as this new attorney really listens to you before giving his opinion (doesn't try to minimize your problem or interrupt) then I would trust his advise. Unfortunately the process in place to solve your problem may require that you sue your original attorney.

They can be trusted as long as they hold their breath underwater.
