Are you his legal guardian - do you have custody of him? If you are not, you cannot claim him.

I'm not his legal guardian. I have already looked up all of the tax laws, including what the one person who responded attached & there is VERY mixed info. I keep finding 5 rules that say "if the person cannot claim anyone, they earn less than $3500, they live with you all year, they are US citizen & under 18" then you CAN claim them even if not related to you. I just want to be sure. Also he is my boyfriends "adopted" son & his mother cannot claim him at all, so its not as if anyone else HAS to claim him.
