I want to claim head of household, because it IS my residence & my bills(boyfriend & his son just reside there w/ me), but I require to claim a dependent. Can I claim the boyfriends son?

According to IRS publication 501, they have to be a relative.  They can be a step-relative through marriage, but just living with you isn't good enough, even if you otherwise supported them.   Example 4 in the publication describes exactly your situation, and says "no".   See the link below, look for "table 4".

tax claims You know, of course, that you must ask a TAX CPA. I believe you can but ask a CPA. Good luck! skep 62 months ago Please sign in to give a compliment. Please verify your account to give a compliment. Please sign in to send a message. Please verify your account to send a message.

sexiesuzy said: 2 I'm not his legal guardian. I have already looked up all of the tax laws, including what the one person who responded attached & there is VERY mixed info. I keep finding 5 rules that say "if the person cannot claim anyone, they earn less than $3500, they live with you all year, they are US citizen & under 18" then you CAN claim them even if not related to you. I just want to be sure. Also he is my boyfriends "adopted" son & his mother cannot claim him at all, so its not as if anyone else HAS to claim him. 62 months ago

Are you his legal guardian - do you have custody of him? If you are not, you cannot claim him.
