Can I be evicted from a 7 day rental of a vacation house?

Postby bardoul » Wed Dec 14, 2011 1:22 am

I'm renting a beach house in NC for seven days. The lease agreement says no pets. I plan to bring a pet. I understand its breach of contract, but can I be legally evicted within the time period necessary? Are there minimum notice periods and laws against self-help, or are there exceptions for short-term rentals?

This would fall under hospitality laws and the hotel or innkeeper makes a contract with the guest for a specific amount of time to stay. If this contract is broken the innkeeper can take steps to remove you or disable you from accessing the property and charge you an expenses incurred to achieve it.

You might want to reread those laws or better yet get a lawyer. The law doesn't require pets to be allowed AND if you bring one when they are not allowed you will be guilty of a class 3 misdemeanor

In canada (Other then hotels and motels), all rental agreements, leases, and contracts that have a no pet clause are voided. You can bring an animal in before hand, or after, but do it after it's signed.
I don't know about the states, but I think it's the same.

i am not about to agree with this; that a state law mandates
all hotels =motels accept "pets." I bet you, instead, it
says "dogs and other mobility certified animals are accepted."
but to bring big parrots, pigs, horses, are not allowed in any
hotel anywhere and I have no problem eating crow;
please show me any NC law that says i AM WRONG.

These types of rentals are probably managed under hospitality laws (i.e., for hotels, motels, B&Bs, etc.), which means you can be forced to leave the same way a hotel can force you to leave. Only tenants are subject to landlord/tenant laws and in most states, you must be resident for at least 30 days in order to claim tenancy.

So, the Lessor can insist you leave, with the help of local law enforcement, if necessary. You may also forfeit any deposit/payment you've made since it would be too late for the Lessor to get another renter.

Your plan to bring along a pet against lease rules is as stupid as it gets. They will discover that you have a pet present, and you will have more problems than you know how to handle. They may not evict you, but they can make your vacation one you desperately want to forget.

Abandon this silly plan and either put your pet into boarding for the week, or find a house which DOES allow a pet.

The beach house does not fall under the hotel/motel mandates and if you are going against the rental agreement by bringing a pet you can be evicted and sued for cleaning fees even if there are no damages. Pet free rentals have to be clean from pet dander as many renters are allergic to animals. I recommend that you reconsider

"because NC state law mandates that all hotels / motels under hospitality laws permit pets" - You aren't staying in a hotel or a motel. Your rental is covered under the NC Vacation Rental act. This makes no mention of forcing someone to allow pets. It also has provisions for expedited evictions for violation of contract, requiring only 4 hours notice to quit the property. So if you show up on Sunday with your dog, they can tell you they'll be in court filing eviction Monday morning, and the hearing will occur between 12 and 48 hours later. They CAN evict you by the end of the week.
