Can I claim Colorado Lemon Law?

I purchased the car last night February 22, 2012 at approximately 8:30 pm, while driving the car home it broke down. I came to a stop light and the car shut off and started smoking, would not start, and oil leaked out under the car. Message said low coolant level. This happened at approximately 9:15 pm the same night February 22, 2012. I spoke with the salesman, he said he could come with a tow truck, tow the car back to the dealership and have them fix it no cost to me. I told him I wold like my down payment back and to not purchase the car, he told me just because of this I would not be able to get out of the contract because I purchased the car as-is. I would like to know if I would be able to claim lemon law for this and receive my down payment back and nullify the contract.

No. You purchased a used vehicle in "as is" condition. The vehicle is not eligible for lemon law protection. Lemon laws protect the buyers of NEW vehicles from serious recurring defects, they do not protect the buyers of used cars from making a bad decision.

Lemon laws only apply to new cars, so the answer to your question is no.

The agreement was agreed on by both parties, which means in order to nullify the contract, both parties have to agree to it. The dealer may agree to cancel the contract, but it likely will not be for free.

Your best option is to take them up on the offer to have them fix it for free (a fantastic offer of good faith on an as-is purchase), Legally, they didn't have to do anything.

Next time you purchase an as-is vehicle, get it inspected by your mechanic before signing any contract documents.

No returns or refunds on car purchases. Also there is no lemon law on used cars. When you purchase a car AS IS means no warranty ,no guarantee. You accept all good and bad with the car as soon as you buy it. The dealer owes you nothing . If he is offering to fix the car for you have him do that as he really doesn't even have to do that...................&&&

It's almost as if nobody knows what the phrase "as-is" means. Your car was cheap for a reason. Lemon laws only apply to new cars because the manufacturer would be held responsible since nobody's really driven the car.

They are going beyond their legal obligation by fixing the car , you bought it as-is. If they were trying to screw you they would have told you its your problem and to fix it yourself

No

Lemon Law ONLY applies to new vehicles.

Also even if was a new car, the dealer has 3 attempts to fix it.
