Can I Evict A Life Tenant?

Postby Wilfredo » Tue Jan 27, 2015 3:12 pm

How do I evict a family member from our property? She has no lease or contract, pays no rent, my mother-in-law!?

She was promised by my husband to live in the back house for free till the rest of her life, but has been making constructions there without our knowledge, closed off common washroom for tenants in the front house, her other son moved in with her without our authorization. Is it good for an eviction? We do not communicate since she filled a frivolous lawsuit against us claiming the whole property is hers(she wants to settle for a half) despite the fact that my husband has been a legal owner for 16 years. He is after stroke unable to communicate and I have to deal with her myself. She loaned my husband money to purchased the house 30 years ago and he paid her back(with interest) and she is using this fact as a ground for ownership. She was on the title with him and then quitclaimed it to him 16 years ago. She never paid any taxes, never put any money in repairs or upkeeps.

Thank you for reply, I know it is complicated.

Can I Evict A Life Tenant?

Yes, it is complicated and there is MUCH more information I would need to be able to help.  The bottom line is that everything depends on what was actually given to her by your husband and whether or not the gift is enforcable.  That being said, even if the property is hers for life, yes, there are limitations on what she can do with it and to it.  So, you may or may not have a right to evict her.

I wish I could provide you more detailed information, but it would take a long time to get all of the information I need from you via email.  I recommend that you contact an attorney in your area and purchase an hour of time to make an informed decision about what to do next.

Good luck!
