Can I expunge my DUI in California yet?

Postby jolie » Sat Jul 21, 2012 1:36 am

I moved to Texas after my dui conviction in 2008 for college. First and only offense EVER! I don't remember much of the case (plead guilty or no contest), but im trying to get an expunged. I never took any DUI classes because I moved and I don't think probation was issued? I let the court know and they told me I had to take DUI classes in Texas. I never took them nor paid the fine. I applied for the application for termination of action for the DMV of CA(13353.5) to get my suspension lifted and to avoid the DUI classes. This also allowed me to get my license in Texas (it was granted). My ticket is in collections with alliance one. Could I qualify for an expungement (pen1203.4) because it has been very hard to get a job. Could I avoid flying to California for a hearing? If I had to appear in court I would rather hire an attorney. Somebody please help! What should I do to take care of this.
GOAL is to possibly get my DUI expunged myselft without having to fly to California or possibly hire an attorney. I will go to the extreme to take care of this if I need to though.

If you even qualify for an expungement, SOMEONE has to be in court. At the very least that would be your attorney.

Your best bet is to hire a criminal defense attorney in the county in which you got the DUI. He'll be able to tell you very quickly if what you want is possible.
