Can i have some LEGAL advice please?

Postby arvad » Tue Jul 24, 2012 7:17 am

Can i please have some LEGAL advice on the following: My dentist FORCED me into having a night guard brace done he told me that I MUST have it even though I did NOT want it and I have been CONNED!!!! I have always been on benefits because I'm disabled autistic and epileptic and because of my autism I have great difficulty understanding things and communicating face to face with people my Dr has declared me permanently un fit for work because of my complex health problems so when he forced me to have the brace at an appointment that was only meant to be a check up i asked that as im on benefit would it be FREE the dentist told me it would be free and assured me I would not have to pay anything he has even signed a form which i have a copy of confirming it was FREE and the dentist practice manager has also confirmed that the nhs are wrong to be billing me as it is free due to my health problems and disabilatys now the nhs have sent me a huge bill and are demanding i pay a sum i cant afford for the night guard brace but had the dentist got his facts right and told me i had to pay i would have refused the brace so as he got his facts wrong in the first place why should i have to pay for the brace when i was told by my dentist and the dental surgery manager that it was free What can i do now i live in the uk and i cant afford the debt thats been shoved on me by the nhs who are demanding i pay and the benefit i get just isn't enough for me to be able to afford it how can they have the cheek to call themselves a nhs service if they do things like this to hard up people like me who cant work so please tell me who is a fault? Who is to blame for this mistake? The social for placing me on the wrong benefit or the dentist for not asking me what benefit im on? is the dentist the social or both to blame for this? they have put me on employment support allowance which i understand is for jobseekers and as i can never work again am i on the wrong benefit? as I was told by my Dr I should be on income support What can i do to avoid paying the costs the nhs are asking for for a brace my dentist told me was free that i didnt even want? am i LEGALLY entitled to return the night guard brace back to the dentists and to refuse it I have fits in my sleep and my dentist knows this surley he shud have NEVER given it to me anyway due to the danger of choaking on it during a grand mal sleep seizure. I cant even wear the night guard brace it cuts into my gums makes them bleed and very sore the dental practice manager advised i come back to have it adjusted or re made but i wont ever be going to the dentists again as im too sacred in case i get lumbered with another huge NHS bill i cant afford to pay. so Who can help me? And what do you LEGALLY advise me to do?

This is from the nhs website

You can get free dental treatment (including check-ups) if you:
are under 18

are under 19 and in full-time education

are pregnant

have given birth in the last twelve months

are getting Income Support, income-based Jobseeker's Allowance, income-related Employment and Support Allowance or the guarantee credit part of Pension Credit

Just refuse to pay the NHS on the grounds that you are as severly disabled as you say above and they won't bother to pursue because lets face it...it will cost them a small fortune to take you to court and if you report them and your crooked dentist to WATCHDOG they will both have eggs on their faces.

Just refuse politely but firmly that you were misled and lied to and you have no money to pay them. They will leave you alone after sending you 2 or 3 threatening letters. That is how life works in the UK now.

Next time you ask a question here, can you please use some paragraphs instead of typing the extremely long and joined stuff that you have written above? Try to think about helping us to help you by making it easier for us to read your overly long question.

Take an adult and go back to the Dentist. Show them the bill and tell them it was their mistake so they must pay for it.
You were NOT forced to have this brace, there is a word called NO. You would have had a couple of appointments to have the brace made and fitted and you could have said NO, or not gone back.
