Can I receive workers comp?

Postby bergh39 » Mon Apr 11, 2011 6:32 am

While i was at work my manager threw product at me to put away in the cooler n walked off. I dropped it and when i went to pick it up i slipped at chipped my heel bone. There were no witnesses. I filed an injury report, but stayed and finished my shift ( 4hrs later). Do I have a shot at workers compensation?

Yes. It was good that you filed the injury report. At that point, your manager should have sent you to the doctor. Go to the doctor NOW!

Maybe. You were injured on the job, and the nature of the injury (dropping something) is reasonably foreseeable.

The question is whether your injury makes you unable to work. Since you finished your shift, that's going to be more difficult to establish. Many employers -- probably most -- would doubt the severity of your injury under those circumstances. However, you would at least have a shot on the claim, if you really want to file one. Have you been to a doctor yet? If you haven't been to one, do it right away. Delaying seeking medical attention would be another red flag.

I hope this is helpful.

Do you have medical evidence? Did you have the heel xrayed? Will you be missing time from work because of the injury? If you have medical evidence to support your injury, then you could file.

what do you mean a shot?
either you are hurt or you are not...
you filled out the report, see a doctor if you need to, in many state you must see a doctor from a list provided by the employer for at least the first visit....
