Can I report my property manager who is being mean and abrupt with us?

Postby siwili » Sat Jun 02, 2012 1:05 am

WE ran into some financial probelems and kindly asked our property manager for more time and she wouldnt give it to us. She was very mean about it saying we should be ready to vacate July 30th at midnight and refusal too will result in IMMEDIATE eviction? can they EVICT us like that? what are their rights? i want to report her...But i think i will wait til I leave to do so? is this right for a property manager to trat their tenant as a victim and so unfairly..we were kINDLY asking for a little extra time.

July is not immediate. Get your rent money together and pay her. You owe rent, pay it or you will be evicted.

Depends on the state you live in but she has to serve you with an official notice that she is going to start eviction procedures against you and usually they cannot do that until the rent is at least 60 days over due, you have been put on notice of the deficit in writing and then if you don't pay she can have an eviction order served on you which may give you only one week to vacate. She is not being mean, she is a business person and keeping the apartments filled with people who pay the rent on time is her job. Even is you somehow catch up on the rent by the end of July she can still evict you from a month to month rental because she served you notice before June 1. This is the real world and polite is nice but it don't feed the bulldog.

No. She is within her rights to give you notice to move. She does not have to give you an extention on paying the rent. It doesn't matter if you were kind or not. She can not afford to get rent late. If you can't afford to pay on time, she will find someone who can. You have 30 days to be out. That should be plenty of time to pack and hire movers if you get started now.

Wow people read closely shes not asking for more time to pay rent she doesn't owe rent. She is trying to get an extension on her lease cause her term is up. Sorry I have no patience for people that don't pay attention.

When your lease expires the landlord can require you to leave immediately. If she accepts money from you after the expiration date of the lease the lease would automatically become a month-to-month tenancy and obviously your landlord doesn't want to do that. The landlord would have to give you an additional 30 days to move should you legally hold-over.

First of all, there is no law against rudeness. There are no agencies that will take your landlord to task or fine her because she was rude to you.

If your lease expires on July 30th and she has given you notice that she is not renewing your lease, you have to be out by July 30th. It is not your landlord's problem that you have run into some financial problems. She is running a business and she has made business decision to not renew your lease. It doesn't matter what her reason for that is and there is nothing you can do to make her give you more time.

As for evicting you, if you hold over, she will have to evict you through the courts. That takes time - anywhere from 2 weeks to a couple of months, depending on where you live. Eviction is not something that happens immediately.

Read your lease to see if it has a hold over clause naming a rent amount that is up to double your current rent. In FL, that is legal and I have it in the lease with my tenants. What that means is if your lease is not renewed and you refuse to leave, you owe the rent amount listed in the hold over clause. You will be evicted and will owe the additional rent plus legal fees and possibly even late fees.

Your best bet is to be packing now and find a place to move. One way or another, you will be out of your current apartment in a few months. It will be alot easier on you in the future if you do NOT have an eviction on your public record.

The owner of the property has the right to require you to move. They must give you whatever time is in your lease and in your state law. Being mean is not a crime.

If your lease is up, she can ask you to leave. 60 days is more than enough notice. She was being direct with you. She probably said nicely that, "no you may not stay" and you didn't listen. It is her property and she is allowed to do as she sees fit.

No law against being direct.

She is not required to extend your lease. The new tenant will be moving in, so you need to be out.

You have a month to move out. That is more then enough time for anyone at all. If you want do it in a month extra days will not matter one bit.

Enlist the help of your family or hire a moving company.
