Can I still sue on an individual basis even if I failed to exempt myself from a class action lawsuit?

My question include:
1. Can I still sue on an individual basis even though I did not exempt myself from the class action lawsuit and also did not include myself in the class action lawsuit? I was never notified. The company I am after is StoresOnline.
2. Are there any Attorneys out there who might sue based on a contigency fee basis if the possiblity of a suit were possible?

as long as you did not opt into the class action then you do not need to opt out. Class action suits are designed to satisfy victims who were injured in the same way (same injury, exposure etc). Class action suits typically do not pay out large amount to the individuals.

Any individual can sue when they feel they were wronged. If a class action status was obtained and settled then you might have a leg to stand on unless the company can afford years of litigation and wait till you run out of money. A lawyer will probably want money up front

In your video you stated that you went broke in March 2007, that's 4 years ago but the statute of limitation in Oregon is 2 years for fraud. So it's very unlikely that you can sue.

As for the class action settlement, I wouldn't take StoresOnline's word for granted: contact the Class Action Plaintiff's counsels in page 9 (Clark, Brown, Wade).

Statute Of Limitation.

It seems it's too late to sue. The best you can do is to have a lawyer to read the whole class action ruling to find out if you were supposed to get a direct notification from StoresOnline.
