Can I take the truck?

My husband and I are separating. We haven't filed any legal paperwork yet, but I need to leave this house before he drives me any more crazy than he already has. I have a job lined up across the country, and family and friends who will help me get back on my feet.

My husband has cut me off from our bank accounts, virtually stranded me at our house, and the only way that I can see to get out is to pack up the truck in the middle of the night and leave while he is asleep.I received a grant for the cost of travel and lodging, so I at least have that to get me there... but transportation is turning out to be a bigger problem than I thought.

We live in California, and I don't know exactly how the community property laws here work... but the truck is in his name. He got it before we were married, but has made payments on it throughout most of our marriage. It was actually paid off at one point during our marriage, then borrowed against again. We have both been insured to drive it the entire time we've been married.

My question is this... legally speaking, can I take the keys and load it up and leave with it? Will he be able to report it stolen if I do this? Is there any preemptive measure I can take to prevent trouble on my part?

is your name on the title are insurance card but you should go to law er check the phone book and get a hold of legal aid but he will get in the divorce

by taking the truck you will create more problems for your self. try renting a truck to get you where your going. that way no one will follow your tracks.

Call a devorce lawyer and get official advice through a "free consultation".
I would aslo question the bank accounts. That should be marital property, but if he was the only income provider he might legal rights over exceeding your rights.
California is very libral state so I would guess talking to a lawyer and hearing some good news.

Another point you made that could really hurt you is taking things and crossing the state line. If your doing somethinmg morally right but legally wrong, crossing the stateline will only make it more seriuos for you as those crimes just became federal charges.

get legal advice from a licensed professional before you run.
