What should I do about a crazy tow truck driver trying to steal my car?

Postby artzai » Tue Jun 19, 2012 8:20 am

I came out of my house to find my car booted. I was on my property. I grabbed my tool box, took my tire off, slipped off the boot and went on my way, leaving the boot laying there. When i got home i noticed a tow truck in the neighborhood driving around. The driver immediately came up to my car when I parked and said what I did was illegal and he will be charging me for vandalism of the company's property if i don't pay the $100 removal fee. I laughed and walked inside. He opened my door behind me and began to walk in. I grab my bat that I keep by the door and told him, he was now trespassing and if he took another step I'd be in full right to protect myself and my property. He immediately turned around and walked out. I then heard him trying to tow my truck. I grabbed my shotgun and went outside and demanded he leave my property, while I began loading it. He left saying he was calling the police and I'd be seeing him in court.

Should I be worried about this. It seems like the jerk was just mad that I out-smarted him when he was trying to scare me out of money. This was almost 24hrs ago and I haven't heard anything yet. And can I take any legal action against him for damage caused to my truck while he was trying to tow it?

I think we need to know a little more information. Did this guy out of nowhere decide to pick your car to take or was there a reason he did this?

Depending on the reason for him trying to take your vehicle will depend on weather or not you could potentially get in trouble.

I would be contacting the policce first, for one he tried forcing himself in your home which is against the law, and 2 he tried stealing your truck, the only way he can tow your truck from your property is if he has a court order or a letter from your financing company unless you own it outright I would contact the police and file a report on him immediatly before he comes and starts more trouble

You should have asked him who called and what grounds he was trying to take it on, especially if it's in you're drive way.

"I grabbed my tool box, took my tire off, slipped off the boot and went on my way, leaving the boot laying there."- This sentence leads me to believe there was no damage or (hopefully) you would have called the police and reported it before removing the boot, so they could see it on your property and then go from there to track down the towing company.

Most of the time, in my experience, someone has to call the towing company and either individuals or companies- he shouldn't just be roaming around doing this to cars . . .
