Can illegal immigrants adopt?

Postby tate8 » Sun Dec 18, 2011 12:22 am

ok my uncle and aunt are illegal immigrants in the USA and im a citizen and well both my parents died in an accident last month and im in custody of my sick (has at least 6 months to a year the doc said) grandmother and the only family i have left are my uncle and aunt and they want me but dont know if they can i have other family somewhere in new york but dont know where we've been looking for them but nothing yet some in Hawaii but they cant take care of me?
- they've been here for at least 30 years they have son of 16 years of age born here (there located in Cali)

And wanted to know if my only hope of family can adopt me or get me in some way without them getting deported or etc.? (although if they were to get deported by the law of immigration one has the rights to say with the 16year old)

I know if someone reads this they may say oh y should they have the rights or bla bla bla.. Trust me America aint doing so great really they'll probably end up like Britain the USA keeps printing money secretly of course to pay off the millions of dollars they owe and if they find out the US dollar wont longer be the world currency ... Sorry but its true before one speaks they should be able to depend what they say
sorry for getting off topic

You are a U.S. citizen? How old are you?

Adoption may be difficult based on their non-status in the U.S., but what I would suggest is to hire a family attorney and seek legal custody for you. You would submit a statement that you would like to live with your uncle and aunt to the court, and leave out the "illegal part" on it. Your attorney should be able to navigate around this issue. Once you turn 18, you are in the clear.

Again, much depends you YOUR age. Basically the judge will decide what's best for the child: you. If you want to live with your family members, he most likely will sign up on this, but don't put their immigration status or lack thereof in the spotlight. A family court is usually not interested in immigration, so don't make it an issue at all.

Yes they can but you'll have to move with them to their country.

Since they are the closest relatives to you, I see why not.

My condolences of the death of your parents.

The court would probably allow it. They prefer to keep families together. The illegal part is what will make it difficult. You need a lawyer for it at any rate. Adoption can be done without one, but there are background checks that are needed. A lawyer can give you advice as to what your options are.
