Can my boss get away with this?

I got burned about a month ago at my job while taking soup out of a steamer. When it happened I went straight to my bosses office asking him may I go home to go to the medical center because I already have bad eczema. Ever since my eczema has really been bad causing cellulitus on my face. My boss told me no and he wouldn't let me go home. The next day I went to the er and to find out I got a thermal burn. My boss never filled out a workers compensation form. Ever since he's been taking me off the schedule without giving me a reason why. What can I do and can he really get a way wit this?

You need to go above him. Call corperate. It sounds liek you work at a fast food joint. FIrst of all, when he told you that you couldn't go home after a burn that would cause you to go get medical attention I would have called corperate the next day. Remember, there is someone above the boss. Keep all of your bills and try to get a statement from anyone you worked with that night who may have witnessed it or witnessed him not letting you go home. He will more than likely lose his job and by taking you off the schedule with no reason, he can do that as long as he doesn't give you a reason. However, you can argue that it is discrimination. He's trying to get you to quit without you calling the people above him... don't give in. They ahve to pay your medical bills, give you workman's comp, etc. He doesn't want you to do that. Keep all of your medical records becaues your insurance shouldn't be paying for it at all... and if they did, they are a horrible insurance company. Make sure you go above him until you can find someone who cares. My guess is if he's a manager, you should be going to the district manager. Call your corperate office! Good luck!
