Workers Compensation in Maryland.. MY BOSS IS LYING!! Claim status under investigation?

Postby oded » Thu Apr 07, 2011 11:39 am

I tore tendons in my wrist at work with an MRI to show it. The boxes I deliver are only one size...Size HUGE AND HEAVY. I assume too heavy by legal standard but who knows, maybe you do?

Anyway, when I was jumping out of the truck with a box I stumbled saving the box and causing a viscous looking lump on my wrist, come to find out it was jacked up. Long story longer... This happened 2 hours before the work day ended so I was hoping I would be good by the next morning. Unlikely with my injury so I showed to work the next day to tell them about my problem. I asked 2 co-workers to help me out the day I had the injury because of the pain and I showed them the lump. My boss wrote me up for not telling them I hurt myself when I did and for "telling co-workers." Now that my lawyer is in full effect my employer is saying "I NEVER REPORTED ANYTHING"!!!! They even reported it to the WC commission. Can you tell me what I'm going to be dealing with here besides a lying boss? Will this workout in my favor?? Just nervous and blown away by it all....I was their best employee. Injured on the 19th and able to be seen by an ortho surgeon on the 21st.

a very hard case to win if at all you waited a full day and didnt even report to your boss you told co workers
this looks really bad

common sense says as soon as i m hurt tell the boss not wait til the next day
for all the know you got hurt at home

you also have this going against you
carrying something while jumping from the truck
you never jump with anything in your hands

your not going to win
did you seek immediate medical attention with in an hour or so of said injury
probably not

you didnt report it at the time it happened
you have no real proof aside from your word as to when it happened

who do you think workers comp is going to believe

you the person who waited 24 hours to report it and not to the boss but to other employees
or your boss

i would believe the boss not you

you sound suspicious and they arent going to believe you and they dont have to

you screwed yourself
