Workers Compensation Claim?

Postby chiram97 » Tue Dec 13, 2011 9:55 am

Welcome to the scam known as "Workers Compensation."

The insurance company does not need a "good reason" to cut off your benefits. All they need is a process that is favorable to them. Lobbying by the insurance industry has resulted in laws written as they wish. These laws provide them ample opportunities to stop providing you with medical care.

They are trying to get rid of you by cutting you off financially. It works like this:

1. The insurance company cuts of your benefits for some made up reason.

2. Because you are not physically able to do the job you were hired to do, your employer fires you.

3. Because you have no job and no income, you can't afford medical insurance.

4. Without medical insurance, you have no evidence to take into court and the insurance company increases their chances of winning.

Contact an attorney immediately. Find one that specializes in workers compensation. You should know that Sedgwick Claims Service is one of the worst offenders of this. I would be interested in knowing what company you work for as there are a couple of the big box stores that are in some fairly serious trouble for this type of thing. Feel free to email if you like.

Unfortunately, there are many people that will assume that those in positions of authority are of such high moral character that they will not scheme and lie. You see that in some of the comments that have been written here. Try to ignore this nonsense.

Workers Compensation Claim?

You can't do anything.
The fact that they've now denied your claim suggests something fishy in your actions and that you're not telling the whole story.

Workers Compensation Claim?

There are several reasons why workers’ comp claims are denied and you have to find it out. Some of the reasons for denial include the following:
• The injury was not work-related (either it wasn't caused by activity on the job or it didn’t happen during work-related duties).
• The injury was due to your work for another company.
• You do not need medical treatment to recover for your injury.
• You do not need time off work because of your injury.

First, you’ll need a lawyer, preferably someone familiar with worker’s compensation claim. Through him, you need to request a hearing before the Workers’ Comp Appeals Board (WACB) to get the insurance company to accept your claim.
You have to file an Application for Adjudication of Claim to get a worker’s comp number.
