Workers Compensation Claim Question?

Postby nissim42 » Wed Feb 29, 2012 2:27 pm

I injured my back at work, and need treatment. I am not missing work or taking time off. My company is insisting I go thought my insurance and that my company will pay the out of pocket. Is this legal? What if this bothers me years down the road? I am screwed?

Workers Compensation Claim Question?

Postby lifton » Wed Feb 29, 2012 2:32 pm

If you were in the course and scope of your employment when the accident occurred, Worker's Compensation will be primary over your health insurance. The insurance company will find out it was a work-related injury and will make you use WC.

If your employer is telling you not to indicate to your doctor it was work-related, it's fraud. They're just trying to save money, as their premiums go up with each WC claim.
