Need to know the context in which this happened. In childbirth, babies can often develop blood clots or swelling on the scalp, even more so if they have had an assisted delivery. Why was the nurse drawing blood from the babies head?
Unless the blood clot caused permanent damage or disfigurement, you would probably have no grounds for malpractice.

As opposed to what? Letting the blood flow freely for a day or two?

What are your damages? I mean how much money have you spent because of this injury?
That is all you can sue for, financial damages.
Do you have competent medical authorities that will testify in court that this nurse caused this damage that resulted in theses expenses ???
And of course you have money for a lawyer. No lawyer is going to take on an expensive malpractice suite for free. Besides, you signed an arbitration agreement when your wife went to the hospital to have the baby. You agreed to have the case settled by an arbitrator and not a jury trial. That will save you some money, buy it is still going to cost you to get this done.

So, what exactly are the monetary damages?
(That is the first question they will ask you)
