Lawsuit against hospital?

A few years ago my grandmother was diagnosed with leukemia. She was 69 and has type 2 diabetes and bad circulation. She was sent to the university of sc medical center. I was talking to her one day and she was telling me that they wouldnt let her out of bed to walk, being that she has bad circulation, I asked her if they had given her the socks that go on your legs to help with circulation to prevent blood clots, she said no. Less than a week later she died from a blood clot that went to her lung. She sat in the hospital bed for almost three months and they wouldnt let her walk or give her anything to help with circulation. Im not sure if they didnt care or figured she was going to die anyway. They knew she had diabetes. My nephew died at the same hospital in the nicu after contracting a virus within a week of being there. He had been in another hospital for almost two months with no problems. I just dont think this is a good hospital. Anyway, my question is, can I sue the hospital for malpractice or something because of my grandmother and would that make them be more thorough and cautious?

When I was in the hospital with circulation problems, my family brought me my socks. They love me.

I guess your family is a little different? Grandma is just a revenue stream to you, I guess. Good luck with your lawsuit.

EDIT: I am sorry, but this question just haunts me. Let us look at what you know and claim:

1. You knew your grandmother did not have any compression socks.

2. You think that the lack of compression socks killed your grandmother.

3. You did NOTHING to get your grandmother any compression socks.

4. You asked no one to get your grandmother some compression socks, even though you knew it might kill her.

5. You now wish to profit from your grandmother's death, blaming the hospital for not getting her any socks.

6. You find yourself blameless in this affair--you are not your grandmother's keeper.

Wow. I am glad I am not your grandmother. I have to go now. After I am done throwing up, I will pray for your eternal soul.

Can you prove that but for a pair of socks, your grandmother would still be alive? Of course not.

Why didn't you get her the socks?? Should you be sued for killing your grandmother? The case is much stronger against you than it is against the hospital!

My god! You let your own grandmother die rather than mail her a $5 pair of socks, and now you want to profit from it. Shame! You need to get right with your god on this one.

How do you know they didn't have her on meds to avoid blood clots instead of TEDS hose? What did they say when you asked about this?

Can you prove the blood clot wouldn't have happened even if she was up and walking? Diabetics are known for having blood clots.

You can sue anyone for anything. If you are asking if you will necessarily win the law suit, I doubt it. If you are asking if a judgment against the corporation, paid by malpractice insurers, will have any effect on the day to day operations of the hospital, I doubt it.

If you want to find out if someone should have ordered compression stockings, and if the stockings were likely to have delayed the death, this is not the place to ask

Medical malpractice occurs when a patient is harmed by a doctor (or other medical professional) who fails to competently perform his or her medical duties. The rules about medical malpractice -- from when you must bring your lawsuit to whether you must notify the doctor ahead of time -- vary from state to state. But there are some general principals and broad categories of rules that apply to most medical malpractice cases. Here's an overview of the law and some of these special rules.
Basic Requirements for a Claim
To prove that medical malpractice occurred, you must be able to show all of these things:
1.A doctor-patient relationship existed.
2.The doctor was negligent.
3.The doctor's negligence caused the injury.
4.The injury led to specific damages.
Even if it is clear that the doctor performed below the expected standards in his or her field, the patient can't sue for malpractice if the patient didn't suffer any harm. Here are examples of the types of harm patients can sue for:
physical pain
mental anguish
additional medical bills, and
lost work and lost earning capacity.
