Can you evict someone in Indiana without using the sheriff?

Postby sayre » Thu Jul 19, 2012 4:46 pm

The immediate possession/eviction process takes too long from the court house to scheduling a time with the sheriff. Is there a way once granted the immediate possession to serve and carry out the bonds by yourself without the use of meeting the sheriff out at the property? Thanks for your help!

You can certainly REQUEST cooperation by the tenant, but you cannot physically touch them unless you want to be charged with assault or worse.

No. Until the sheriff enforces the eviction, the tenant is not legally required to leave. Therefore, if the sheriff does not come out in a timeframe that suits you, you have no legal way of forcibly removing the tenant or their possessions. You're not allowed to change the locks or anything like that either.

I don't know if you need the Sheriff or not in Indiana but it is always better to go through the courts and cover yourself legally. It may take a little longer but at least you won't have to worry about anything coming back to bite you, like a lawsuit. See if you can get the Sheriff to expedite the process for you. Use your city council rep or a cop you know . Networking is the key !

No, if they have to be physically removed only the sheriff or the marshall can do it.
