Car/Wheel Clamping Legality?
Is it legal on private property in the UK?

I work for a Block Management Company and we look after block of flats etc. We have put notices up and advised all residents to park in their allocated space only or they will be clamped.

We have 1 person who is not complying with this.

As we are the Block Management Company and advised the residents where do we stand with regards to clamping the vehicles? Do we require a licence or as it is on private land are we ok to proceed?

Do you know of any website where it says we are ok to carry this out under the law and legislation.

you are the authority on private property and you did notify,however you maybe responsible to damages of anothers private property,ie;wheel damage

What is it you are trying to achieve?

You should consider how much are they failing to comply by - is a very small amount that is so petty it is not worth even looking at other than as a money generating scheme or they bing it blatantly ie taking up 2 spaces? If this is the case before you go in with a jack boot action it may be worthy to establish WHY they are doing what they are doing. IF they are in need of 2 spaces (eg for access for a wheel chair - then you may be required by law to provide this facility - if however they are doing this with wilful intent, then crack on - clamp it and tow it away.

I would recommend you keep photographic evidence of any of the issues with this person as this goes to show their history fo their habits.

I bet they wont do it too often after that.

www.barnet.gov.uk/.../licence-car-clampi… - Has information on car clamping and a useful questions and answers section.This is specific to London but I believe the same licensing and conditions of practice apply nationwide.
