Class action for the next time this happens?

My employer has repeatedly brought in verbally abusive personal that were quickly promoted to manager, director, or VP. I can think of five of them that managed to hold on to their positions for years before termination due to their behavior. All except one of them were people they hired and sponsored from outside the USA.

Next time one of them calls me a “Stupid American”, “Idiot”, or trashes my philosophy (Buddhist) I plan to sue the company because the statements are coming from officers of the company. Several others feel the same way. We are discussing a class action suit. Has anyone attempted this?

Do not say something stupid like “hire a lawyer”. I know that. I want to know if anyone succeeded.

That case has ABSOLUTELY NO class action potential. None.

You need a predominance of issues that can be proven on a class basis. In your pretend lawsuit, you not only have no viable theory of liability, you have no common issues at all.

I think this constitutes a pattern of harrassment and discrimination./ Review the EEOC website and see what fits your situation. Evidence means everything.Begin today and continue. This is good for a number of reasons because later if you are all terminated this could help you get unemployment and so forth. But I think you have a case.

Yes when the company permits management to conduct themselves in an abusive manner they are at fault. That is why all those financial institutions had to pay those women all that money. The company never reprimanded personnel for crude behavior.
