Collect W2 Unemployment If Also 1099 Contractor On The "side"

Postby alahmoot68 » Fri Jun 13, 2014 12:20 pm

I live in San Diego, CA & have been working as a W9 sales employee for the last 6 months or so. I've never had a gap in my 10-year marketing/sales employment history. However, this position is just not working out - micromanagement doesn't work for me and it continues to get worse. I feel the end coming soon, so about 6 weeks ago I signed up as an independent consultant(1099) with an MLM company which has gone incredibly well so far - I made $500 my first month, will do about the same this month and will increase as they are consumable products. I'm wondering, if I lose my W2 job, though I continue to adhere to all the micromanagement demands, so it would be at no cause of my own, can I collect unemployment if I am a 1099 on the "side"?

Thank you!!

Karen:

Yes, under California law, you may be eligible for unemployment insurance benefits even if you are still working part-time, as long as you meet the other eligibility requirements.

Here is a link to the California Employment Development Department(EDD) web site, which explains eligibility, calculation of benefits, and how to apply:http://www.edd.ca.gov/unemployment/Eligibility.htm

I hope this is helpful to you.
