Will my employee be able to collect unemployment if i fired her for a social network for mean things about me?

and she ranted because i missed a day off her paycheck and when asked about her pay i got really mad and screamed at her told her she not getting it today.Why would she ask me about it?She could wait she had one half of her check i gave her the rest when i fired her, but the thing is she did not mention my name or the company and never had a write ups I'm her boss she cant talk about me i showed her now shes jobless and i do not want her to receive any compensation.The state is Florida anyone know what i can do to stop her?She ranted about her pay and how angry she was at me.




Am i at fault or is she? if any one know about this free to answer.my company has no policy about outside work activity's

I was not her friend on Facebook.Co-workers were Im re posting this because i want to give all the details

You said she didn't post your name or identify your company but only published "mean things." You also describe a situation where you both "ranted" at each other in the workplace. I suspect the First Amendment to the Constitution, as far as freedom of speech is concerned, will protect her in any unemployment action she may seek.

I don't think she could since you didn't close down the business and retire, then you'd have to pay unemployment. But I'm not to entirely sure about it, if she does sue or try to collect, just go to a lawyer and see if this could be a case.

You can't get unemployment if you are fired for cause. Can only get it due to staff reduction due to reduced sales etc. She can request a hearing and you will have to come to the unemployment office for the hearing if she tries to say that the firing was unjustified.

you did not pay her and when she asked for it you yelled and fired her
you were very wrong
and she should sue you for wrongful termination

if she did it at work, then she may not be able tocollect, if she did it at home she will get unemployment

She can get it since she has no write ups. And she wasn't wrong in requesting her pay she worked the hours and needed to be paid. She has bills to pay food to buy and rent/ house payments to make so yes she had every right to request her check. You had no right to just pay her half. Also if she really wanted to push the issue she can file charges of racism against your company. And honestly with what you have written here I hope she does.

she asked, about a shorted paycheck,and you hollered & got mad,,she quit,,,she may get a pass from the adjudicator
based on getting fired w/o cause,,and racism,,,you casual mentioning that 'they dont like black waitresses' says something stinks in your company.
,she could collect,whch might be a pittance if you were paying her minimum,and making quarterly contributions to the state based on that minimum.she has the right to file a claim, then they ask you in a phone interview what happened,and send you both a letter about the outcome,deny,allow,whichever.as the girl did,she also did not mention your company's name,so that issue is immaterial to the job service hearing.
