Conservatory raised platform, causing water damage on my property?

Postby dacy17 » Mon Jul 02, 2012 6:46 am

I had a neighbor who built a conservatory in Aprox 2004, after having it built, they sold up and moved on, since this time, we’ve been having water problems, down the side of the property,

All my trees have died, then my retaining wall gradually decade over the years, to the point of the bricks starting to come loose and crumble apart,

My house is on land naturally lower that thy neighbor, so we have a retaining wall running along side the property, on closer inspection though, I have found that the conservatory that they had built as a raised platform attached to it, which as been built up much higher than the level of my retaining wall,

When we have a downpour the side of my house become a swap and my basement wall is soaking wet, I’m really concerned the damage this is causing to the foundations of my house and would appreciate some educated and informed advice on this please

I have checked regulations on this and it does state that “No verandas, balconies or raised platforms.” Are allowed on conservatory’s

what are my rights and what would be the best way to approach this, as the neighbor not very cooperative.

I live in the UK

many thanks.

I think its a problem for the people who now own the property, you need proper legal advice, but as they own the house and conservatory if its causing a problem with your property they will need to get it fixed.
