Contract Law: can a cancelled check be used to prove a written contract?

Postby cadby » Fri Jul 13, 2012 11:31 pm

I would like to sue for breach of contract (GA), but it has been over 4 years, and I know that I can only sue beyond the 4 year time period if the contract was written. I don't have a contract per se, but I do have many cancelled checks and a letter or two making reference to the services that were supposed to be provided (i.e.rates being raised). This is reference to horse boarding. I have pictures of my horses at her facility, as well as photographic evidence of the condition of the horses (while still on her property) as proof that she did not provide the care that was agreed upon. I have been all over the internet and have not found an answer to this specific issue. THANK YOU in advance!!

No. A contract spells out the agreement. All a check proves is that you paid them. In fact it doesn't even prove what you paid them for.
