Court case help please ? Would I win ?

Postby wattekinson86 » Mon Jul 30, 2012 9:42 am

Last month I had my car wrote off when I female driver crashed into it when it was parked outside my house. She admitted 100% fault and my was wrote off and I got £660 from her insurance company. However with the cost of the car 4 months ago £800 and the money I spent on tyres and full service I am now around £700 out of pocket. If I was to take her to small claims would I stand any chance of winning ?

No.
You couldn't take them to court for it, and you couldn't win.

No, once you accepted the 660 it's over.

Your dispute isn't with her - it's with the insurance company. She accepted responsibility, and her insurance company agreed and paid out. You are disputing their assessment of the value of your car. Take it up with them - but don't even think about taking them to court because they have the resources to fight any such claim.

You accepted the offer of £660 from the insurance company nothing to do with the
other driver so you cannot take her to court
