Dating laws in Michigan?

I'm 15 and my friend is 18. Hes 3 and a half years older than me to the exact date and we live in Michigan. He asked me to go out and I've ad the hugest thing for him for about 3 years! So my question is: In Michigan, are we allowed to date, because I heard I have to be 16? and I know no sexually contact until 18, correct? and what does that involve? Like could the farthest we go kissing?

Please no mean comments, I know everyones gonna say he only has one thing on his mind, but i know for sure thats not it. We are family friends, that's not how it is.

Where do you guys hear these things? I am constantly astonished at how much misinformation there is about these things.

We have to give this answer every time:


There are no laws about dating.


There are laws about sexual activity (and the laws pretty much start at "second base"), but none about dating. In fact, the specific Michigan law makes it a crime to have sex (or "sexual contact") with someone under the age of 16. (Check part (q) of the link I posted if you really want to know what the state of Michigan considers "sexual contact.") Also, these laws are different in every state. In some states, the legal age is 18.

In fact, now I'm curious. Would you mind telling me where you heard that there are laws about dating?

The age of consent in Michigan is 16. Waaay too many young girls on this site talking about nasty custody battles, etc. It's really sad. :(

read thru it & see what it says.. here is a place to start & it answers your question.. YES, he could be charged with a FELONY... not only by you, but by your parents, his parents or even a school counselor or concerned adult ----

750.520d Criminal sexual conduct in the third degree; felony.
Sec. 520d.

(1) A person is guilty of criminal sexual conduct in the third degree if the person engages in sexual penetration with another person and if any of the following circumstances exist:

(a) That other person is at least 13 years of age and under 16 years of age.

--- keep in mind that oral sex can be considered a form of sexual penetration... regardless of who is giving or receiving... as can "touching" in certain ways ---

There are no laws that govern 'dating', the laws step in when sexual contact is made.

The only laws you have to worry about the 'laws' your parents put down, if they say no, then the answer is no, end of story.

750.520d Criminal sexual conduct in the third degree; felony.
Sec. 520d.

(1) A person is guilty of criminal sexual conduct in the third degree if the person engages in sexual penetration with another person and if any of the following circumstances exist:

(a) That other person is at least 13 years of age and under 16 years of age.



No, kissing in an of itself won't get him arrested, but if you go much further than that, and you have a DA that is willing to go after him, he could find himself as a registered sex offender for the rest of his life.

I would strongly suggest that you wait to do anything besides be friends until you turn 16, and in the meantime, have a talk with your parents to make sure they are ok with it all, remember, if they say no, then the answer is no. They have other legal avenues available to them if they tell you no, and the two of you decide to do as you please.
