Divorce In Texas & Custody

Postby Witt » Mon Jun 16, 2014 5:26 pm

My husband has an attorney as do I. He is trying to rewrite the divorce papers to his specifications in great detail, We have a 4 yr. old daughter and he is making demands such as each parent should have a picture of the other parent in the child's bedroom, and wanting me drug tested and the test go directly to him, and that any man that comes to my place I may start dating that they leave by a certain hour at night & not return until the next day at 8 a.m., etc. We are talking dictating my life and reporting to him for how I am going to live. After he had visitation one weekend with my daughter was court ordered to return her on Monday by 11 a.m., he was not available all weekend for me to talk to her over the phone & basically kidnapped her & no one knew where she was until sometime Tuesday when he was expected in court. He has composed a 32 page document that is so wordy and convaluted and I might say psychotic.  He really does have some king of mental issues.  Would a judge allow such garbage and control over to an exhusband in a legal document? I do not do drugs but there is supposition of possible child molestation by him with my 4 yr. old. My friend would like to report him and have him investigated. Is there any organization besides the Child Protective Services that she can voice her concerns to? Please help me in San Antonio, Texas.  Jodi Sunshine

Divorce In Texas & Custody

Postby Leander » Sat Jun 21, 2014 12:39 pm

Dear Jodi Adams,

I will offer what I can, but to be truly honest, it always seems that Texas has a sort of legal system "all it's own."  Your husband appears to be wanting to control your life after the divorce is final, which I believe most judges would be able to see through.  As for the control and the number of pages he's written, I would think your attorney may be able to use that to make some sort of emotional abuse case in your behalf.  That is my best suggestion.  I truly think if you involve Child Protective Services at this point, both you and your husband may have more to deal with than just the divorce.  In some states they can get quite invasive and never go away.  I suggest you speak to your attorney about using the 32 page document to prove some real control issues, instability on his part, and possible emotional abuse both of you and your child.

I wish you well and I'm sorry I can't offer more.

Kind Regards,

KD Liz
