Hello, i am a US citizen and about 15 years ago i got married to a Mexican man from Tijuana BC, we were together for 10 years and we physically separated almost 5 years ago,we married in Tijuana Mexico as well, we had 2 kids that are 12 and 13 years of age, currently they stay with me on the weekdays and with the father on the weekends i have filed for a divorce online but till this day i can't get my ex partner to fill out the paperwork and i can't afford a lawyer, i have no other problem with him, he is responsible with the children and obligations and so am i, but i want him to respond to a petition of divorce, what is the best thing i could do and where is is better to file, US or Mexico.

Hi Guadalupe, I am curious to know how you filed for divorce online. What State do you live in? A dvorce without a lawyer is often possible without a lawyer in the US or in Mexico when both parties are on the same page. However, when one of the partners is unwilling to cooperate and there are children involved, things become more complicated. I assume you live in the US. Even though you married in Mexico, you can file for divorce in the US in the State where you live. I would do this to minimize your costs. You might be able to obtain free legal assistance from a legal aid society.
