Do I have a case? military medical malpractice?

Postby hardin » Thu Oct 27, 2011 10:22 am

When i was 6 months old i was overdosed by a military doctor while my family and I was stationed in Italy. My father was active duty military at the time. they thought i had pnemonia but it was a cold. The next day i went to renal failure. I lost both my kidneys. when we got back to the united states my mother went to a lawyer in Kansas City to file they said she couldnt because my father was active duty at the time and that i had to wait till i turned 18 to file. I called a lawyer the other day and he said it was too late to file. But it happened to me when i was young and not my parents? Isnt their a a law for that? Do i have a case? Thanks.

I think the second attorney is correct, but talk to another attorney to be sure. There is a time limit to bringing claims against the government, and I don't believe that time limit is extended just because the plaintiff was under 18 at the time the injury occurred.

If it turns out that the second attorney is correct, then you may have a malpractice case against that Kansas City lawyer who gave you that incredibly bad advice.
