Do I have reason for a malpractice suit?

Two years ago my left wrist injured in a fall at work. Worker's comp picked a orthopedic surgeon for me to see. After seeing him for almost six months, he did surgery to remove scar tissue that had accumulated in my wrist. This surgery did not help at all. After 9 months more, he did surgery to remove a bone in my wrist and replace it with a ligament from my left forearm. This surgery only made matters worse. I now have permanent damage to my wrist and will never have full use of it again. I am concerned that this surgeon waited so long to do the second surgery, which according to another doctor is the surgery that should have been performed in the first place, it caused the permanent to my wrist.
My question is, should I contact a malpractice attorney about a possible malpractice suit against this doctor. I feel that he was dragging this out as long as possible to get as much money as he could from the worker's comp insurance company.

what you feel and what can be proved in court are two different things. your case is "iffy" at best. consult a lawyer before making a decision.

Do you know that you will have to pay the money back to the WC insurance company, if you win a lawsuit?

You would have to get a medical doctor to testify that the first doctor screwed up and that you were injured as a result of the error. Then you have to separate the original injury from the doctor caused injury.

It does not seem that your case is worth a lot of money. For that reason, you may not be able to get a malpractice attorney interested. But, the first consultation is free, so talk to an attorney.

First of all, surgeons don't get paid based on the length of time between surgeries. It doesn't matter if he waits nine months or nine years-the pay is the same.

I think you have enough to see a lawyer. These things are complicated, so I couldn't tell you if you have a case, but I definitely think it's worth a visit to a lawyer.
