Do I Have Rights Over The Ashes?

My sister died about a month ago. We were both adopted. Her adoptive mom was abusive and lost rights over my sister when she turned 17. She cremated her because I told her that is what my sister said she wanted but she will not give me the ashes. I am my sisters next of Kin. Do I have the right over the ashes? I know my sister wants her ashes in the ocean where she went to swim with dolphins when she was little. That is all I want to do...I want to give her that...

Sadly, you are not next of kin. Her adoptive mother is, legally, even if she "lost rights'. That being said, you might try taking her to small claims court(its free) and see if you can get your sisters ashes. You stand a good chance, I think - its worth a try.I really hope this works out for you. TurboB 22 months ago
