I was injured at work and my expenses were paid by worker's compensation (Texas). I eventually had to have surgery 6 months after my injury date and the doctor that performed the surgery did not do the procedure correctly and it has been determined that I have severe nerve damage and I'm in more pain now than when I was injured(malpractice) plus worker's compensation has quit paying for my medication and totally denied an implant a pain management doctor wanted me to get. It has been 5 years now and I'm about to settle with the doctor and his attorney. My question is do I have to payback worker's compensation out of the money I receive for this doctor's error?
