Do I need a Copyright or do I need a Trademark?

Postby vanaken25 » Sun Apr 03, 2011 4:38 am

I am starting a line of belts for women. They will have the logo prominently displayed on them.

Do I need a trademark or do I need a copyright? The United States Patent and Trademark Office Web site is not exactly easy to navigate through.

Does anyone know the answer to this question?

Do I need a Copyright or do I need a Trademark?

You need a trademark for any graphic design that you use to identify your product. You need a copyright for any wording that you use to describe your product. Wording can be included in a graphic design and be trademarked. Of course it has to be unique. The more distinct it is, the less likely you are to face infringement lawsuits. The best way to avoid trouble is to retain an attorney. The attorney you are using for your incorporation and other business start up issues can probably help you.
