In Dec. 2010, I visited my dentist to possess two cavities filled. Within 10 minutes of me making the dentist office, walking to my vehicle and driving for a maximum of five minutes I lookup into my rear-view mirror and also to my fear, I'd an enormous blister developing around the right of my mouth (the medial side she was focusing on and concerning the size of the gold dollar)  Iam betting the damage was caused using a device she was utilizing or perhaps a substance she used. personally I think this dentist ought to be prosecuted since I instantly returned to her workplace to exhibit her what transpired, she tried to clean it off that I was getting an allergic reaction to latex!  And lets get this to obvious, I'm a lady having a kid and experienced decades of dental, orthodontic, Ob/Gyn, common treatment of health-related physicians applying latex and not had a problem. I also visited get an allergy test for latex and undoubtedly tested negative following the event (since an allergic reaction to something doesn't reveal in to a blister/burn).  fast-forward to Jan 2013, I still possess a lasting stained, silver dollar sized scar on my experience.   I've pigmented skin which damage left me with clean stained skin on my experience for more than a month following the damage happened. I got photos and video documented the damage for that first-year.

The statute of limitations on dental malpractice in NY is 2.5 years so you have a very small window to file a case.  No one here can tell you it was malpractice.  Based on what you posted it does sound like an allergic reaction if not to laytex possibly to the lidocaine used for numbing you up.  If it is an allergic reaction then it would not be malpractice.  The big issue is did you seek any medical treatment?  If you did not get the injury diagnosed and treated then proving malpractice is going to be more difficult.  Consult local counsel.

After I left the dentist, I immediately went to the E.R.  Thr ER doctor prescribed a burn cream to treat the injury with.  I went home that day and made an appointment with my dermatologist and allergist and for the following day and both of them wrote a diagnostic report.  The dermatologist wrote that I hard received a burn/abbrasion to my face.  My allergist wrote that the injury was not any type of allergic reaction and that in fact the skin on my face appeared to be burned/rubbed off.   Thanks for your help, I will contact someone locally.

The law of restrictions for dental negligence in Ny is 2.5 decades, and so I indicate that you simply have your case examined with a negligence lawyer ASAP when you are quickly nearing the full time limit.   no body below may decide when you have a case or not.  Sadly, a poor result doesn't suggest that negligence occurred.
