Do you a patent a clothing line or trademark it?

Copyright.


You could patent it if there were a major difference in all other clothes like say it changed size to fit everyone no matter how big or small.

Trademarks are things like company names, and logos. McDonald's golden arches are a trademark. Pepsi's blue and white cans are a trademark.

Trademark it or register it. You are trademarking the brand of your clothes and the logo.

Not unless it has a unique function, such as zippers that squirt out water (then you'd patent it) so that other companies could license that idea for their products.

There is no copyright protection for clothing, under US copyright law, although an original ornamental design placed UPON the cloth or clothing could be copyrighted. You could try to register a design patent, but you'd be wasting a lot of time and money on something that might not be granted and might not be enforceable in the way you'd planned.

Trademark is the way to go.

There are lots of websites that will help you figure this out, and then go talk to any attorney about it.
