Do You Have to Have A Patent For Everything?

Postby reuben29 » Thu Mar 31, 2011 5:38 am

I want to do a purse with special things on it, and no one has it anywhere (and sorry don't want to give it out for fear of copycat) and was wondering do I HAVE to HAVE a patent, and license. It would be a purse for making life easiter and convenient. No special names, or trademarks or logos necessary.

I mean I don't have $7,000 to spend on a patent, and attorney and other etc......

Tell me do I still need one?

You don't need one but you run the risk of losing a challenge if someone copies your design and tries to claim it. Also if someone can claim that they created it, apply for a patent and attempt to sue you.

If you were planning to manufacture, market and sell the purses yourself it would cost more than $7000.

If you truly believe that you have something marketable and have done your homework (ie determined your market and how to approach it, potential profits, will you manufacture it or license it to another company) then maybe you should seek funding via a businesss loan or maybe a government grant.

Just be sure to get a real patent attorney and not one of those invention companies that promises to promote your product to industries.

yes, if you dont get a patent for it and you produced it to sell it would be jus like saying what it was in your question. if you produced it without a patent then anyone can steal your idea and produce the exact same thing if they wanted to and it would be legal. however it is not 100% absolute if you jus want your product out there then you can produce them and sell them.
