Does this sound like Medical Malpractice or should I let it go?

Postby bearchan » Wed Mar 07, 2012 2:02 am

My mother died recently due to complications of a CT Scan liquid. Kaiser Hospital told her to take her diabetic pills in 2 days after the scan. Well she did just that and she died because of it. When she took her diabetic pills like they told her to the dye/liquid was still in her body so when the diabetic pills was taken it caused her massive kidney failure and she died. The hospital knew she was older and taking pain pills which pretty much meant that she didn’t process food and go to the bathroom like a younger person. They should have told her to take the diabetic pills much later on at least 4 days. My family just feels they should have monitored her better. Does it sound like a winnable case or should I just let it go and let my mother rest in peace?

it sounds like something serious enough to see a local attorney who specializes in medical malpractice cases. If your mother's care was not up to the applicable standard of care you may have a claim to make.

This is not the forum to get reliable opinions concerning medical malpractice. See an attorney in your jurisdiction who handles medical malpractice matters.

I think you have a case of medical negligence and with her being a diabetic she needed to take the pills everyday so they should have arrange some other scan for the investigation. The kidneys help remove iodine out of the body. Those with kidney disease or diabetes need to receive extra fluids after the test to help flush the iodine out of the body and did the hospital tell her that or give her extra fluids? Good Luck

Where are you getting your information from? Do you have a physician who will testify to this in court, or is this just what some guy told you?

Medical malpractice is very difficult to prove. You have to show that they acted negligently or that they intended to cause harm. Just showing that they made a mistake is not sufficient. I would say let it go, it's not worth the hassle.

Remember too that once you file a lawsuit, they will probably drop your insurance as well.

First we don't have all the facts but you are making many assumptions:

Before hiring a lawyer, hire a licensed medical expert to review the case.

Don't take for granted whatever you were told by your family unless they are licenced medical doctors.
